<li>Involuntary manslaughter is a lesser-included offense of murder. In an indictment for murder, the elements of crime embraced therein are murder, voluntary manslaughter, involuntary manslaughter, and simple assault.</li>
<li>If there is any evidence that would support a conviction for the lesser included offense, the trial court must, upon request of counsel, instruct the jury as to the lesser included offense. An instruction, however, must be based on more than a scintilla of evidence. An instruction is properly refused when it is unsupported by the evidence.</li>
<li>Criminal negligence as the basis for involuntary manslaughter is judged under an objective standard and, therefore, may be found to exist where the offender either knew or should have known the probable results of his acts. Thus, criminal negligence is acting consciously in disregard of another person's rights or acting with reckless indifference to the consequences, with the defendant aware, from his knowledge of existing circumstances and conditions, that his conduct probably would cause injury to another.</li>

most favorable to the Commonwealth, the prevailing party in the trial
court. A court may not disturb the trial court's judgment unless it is

actually inflicted, a battery has been committed regardless of how small
the injury might be. Battery is the actual infliction of corporal hurt on

actor intends to touch offensively rather than accidentally or

sufficiency of the evidence on appeal, a reviewing court does not ask
itself whether it believes that the evidence at the trial established
guilt beyond a reasonable doubt. Viewing the evidence in the light most

rational trier of fact could have found the essential elements of the

to accept, in toto, either the theory of the commonwealth or that of an
accused. They have the right to reject that part of the evidence believed

doing, they have broad discretion in applying the law to the facts and in
fixing the degree of guilt, if any, of a person charged with a crime.
Consequently, if a proffered instruction finds any support in credible
evidence, its refusal is reversible error.<o:p></o:p></li>

offense instruction is only proper where the charged greater offense
